1. General terms

1.1

These terms and any other supplementary terms referred to herein (collectively referred to as the “Terms”) apply to any use of www.housingtarget.com (referred to as the "Accommodation Search Engine"). The Terms apply to the User’s use of the Accommodation Search Engine, which is operated by Housingtarget.com ApS, Mynstersvej 3, 1827 Frederiksberg, Denmark, Central Business Register (CVR) no.: 36997761.

“User” means the person who creates an account with the Accommodation Search Engine.

1.2

The Accommodation Search Engine seeks, through crawling, to aggregate all vacant accommodation in Denmark, Sweden, Germany and the Netherlands from accessible websites. The Accommodation Search Engine is also a fully automatic market platform, where users can post user-generated content and advertisements, matching accommodation providers and accommodation searchers and allowing them to exchange contact details and access relevant search results.

1.3

Functionality for accommodation searchers: The Accommodation Search Engine is first of all a search engine that shows accommodation searchers which rented accommodation is vacant on the market at a given time. The Accommodation Search Engine crawls the internet looking for vacant accommodation on accessible websites and shows a raw data extract in the search results. The search results are displayed in English; however, the source of the information may often be an accessible website in local language (jointly referred to as "Local Language"). If the accommodation searcher wants to know more about the accommodation, he is referred to the original source. It should be pointed out that the Accommodation Search Engine does not establish direct contact between accommodation searchers and accommodation providers, nor has the Accommodation Search Engine entered into any agreements with accommodation providers for that purpose. Some of the accommodation on the Accommodation Search Engine is advertised by the accommodation providers themselves. If the accommodation searcher requests further details, he will then receive an email with the accommodation provider’s contact details.

In most cases, the accommodation searcher will have to upgrade to become a PremiumUser in order to get further details on the accommodation. Accommodation providers may contact accommodation searchers by email or telephone and offer accommodation that fits their preferences (paragraph 3.2 specifies which services are available free of charge to all users and which services are available to PremiumUsers only).

As a service for our PremiumUsers we include, to a lesser extent, housing from payment portals if we consider that the property in question is only available on that property search engine. It is communicated extremely clearly to our non-PremiumUsers and PremiumUsers if a given ad links to a payment portal.

1.4

Functionality for accommodation providers: Accommodation providers may use the Accommodation Search Engine to advertise vacant accommodation. An accommodation provider may advertise for tenants or contact accommodation searchers who have posted an advertisement for available accommodation directly. If the accommodation provider wishes to contact an accommodation searcher who has posted an advertisement for available accommodation, the accommodation provider will receive an email with the accommodation searcher’s contact details. In many cases, the accommodation provider will have to upgrade to become a PremiumUser in order to contact accommodation searchers who have posted an advertisement (paragraph 4.5 specifies which services are available free of charge to all Users and which services are available to PremiumUsers only).

1.5

In order to register as a User, you must consent to receiving emails with information about accommodation, services and news, as this is an important element of the Accommodation Search Engine service. You may withdraw your consent in accordance with applicable law, though we may not be able to provide the Accommodation Search Engine service if you do.

2. Registration, cookies and emails

2.1

By creating a user profile on the Accommodation Search Engine, the User accepts these Terms.

2.2

By creating a user account on the Accommodation Search Engine, the User consents to receiving emails from the Accommodation Search Engine. Users may unsubscribe from emails by clicking on the unsubscribe link in the email. When clicking the unsubscribe link, the User is directed to a page where it is possible to change one’s preferences. The User may also withdraw all consents at any time by disabling his/her profile at the bottom of the page “Your data” under “Your profile”.

2.3

When using the Accommodation Search Engine, the User agrees to the use of cookies in accordance with the terms laid down by the Accommodation Search Engine. Cookies are used for the purpose of improving the User’s experience when visiting the Accommodation Search Engine. If cookies are disabled in the User’s browser, the User may still use the Accommodation Search Engine to a certain extent. The User can always delete cookies stored on the User’s computer in connection with his/her use of the Accommodation Search Engine. See a detailed description in our Cookie Policy.

2.4

The User must stay updated on these Terms of use of the Accommodation Search Engine and accepts that the Terms may be changed at 30 calendar days’ notice. All significant changes to the Terms will be communicated by the Accommodation Search Engine, and the User will also see this information when logging in to the user account. If the changes involve privacy or marketing law issues which require renewed consent, the User will be asked to give such consent when logging on to the Accommodation Search Engine next time. The price of existing subscriptions will never be changed.

2.5

The User may disable his/her account on the Accommodation Search Engine without notice. If the User has a subscription, the User must cancel the subscription before the account can be disabled. PremiumUser access to a disabled account will not be automatically renewed, and the User will not be charged payment for any subsequent PremiumUser access periods. Amounts already paid to get PremiumUser access will not be repaid.

2.6

If the User nominates a third party to act on his/her behalf and to use his/her profile on the Accommodation Search Engine, such third party must provide adequate proof of authority to act on the User’s behalf.

2.7

The user accepts that all user support services offered by the Accommodation Search Engine are provided in English.

3. For accommodation searchers

3.1

Only persons looking for new accommodation can register as accommodation searchers with the Accommodation Search Engine. The posted Housing Seeker Profile must be in English, and the User must ensure that the content of the posted advertisement is true and accurate and that no contact details such as telephone numbers or email and website addresses are included. The Accommodation Search Engine may show the uploaded material or part of it on other websites, on social media and on its business partners’ media. The User must disable advertisements for accommodation that are no longer relevant within two days. If the User fails to do so, the User’s account will be closed immediately, and the advertisement deleted.

3.2

The following services are available to accommodation searchers free of charge: i) they may advertise for available accommodation and be contacted by accommodation providers who are PremiumUsers, ii) they may opt to receive email notifications of vacancies, and iii) they may contact accommodation providers who are PremiumUsers. The following advantages are available to accommodation searchers who are PremiumUsers: i) their advertisements will be highlighted and get a good position in the list of search results, ii) they may be contacted by all accommodation providers (and not only PremiumUsers), iii) they will receive an email notification of the most sought-after accommodation before others, and iv) they get access to all accommodations advertised in the Accommodation Search Engine (if an accommodation has been posted, they will receive the accommodation provider’s contact details, and if an accommodation has been detected by the crawler, they may go to the source).

3.3

When registering as an accommodation searcher, the User must post an advertisement for available accommodation with a description of the requested accommodation within 3 working days.

3.4

The accommodation searcher may also upload a photo when posting the advertisement. The accommodation searcher is responsible for ensuring that the photo is relevant, customary and lawful as determined by the Accommodation Search Engine, that it is not of a sexual nature, and that the accommodation searcher holds all intellectual property rights to the photo. If any uploaded material infringes third party rights, such material will be removed as soon as the Accommodation Search Engine is made aware of the infringement.

3.5

Accommodation providers may contact accommodation searchers by email or telephone and offer accommodation that fits their preferences.

3.6

In the advertisement for available accommodation, the accommodation searcher may offer the accommodation provider various assistance. The accommodation searcher may only offer ordinary, legal and non-infringing services as determined from time to time by the Accommodation Search Engine (as an example, the User may not offer sexual services). The accommodation searcher must always be paid separately for such services in accordance with applicable law and may e.g. not accept a rent reduction as remuneration. It is the Users’ own responsibility to ensure that agreements for provision of services are entered into in accordance with applicable law, including for tax reporting purposes.

4. For accommodation providers

4.1

When registering as an accommodation provider, the User undertakes to contact accommodation searchers only with offers for accommodation that match the accommodation searcher’s preferences and needs as specified in the advertisement for available accommodation.

4.2

Only accommodation providers, estate agents and lawyers representing accommodation providers are entitled to create an account with the Accommodation Search Engine. Users may only advertise vacant accommodations which they are authorised to handle or which is owned by themselves.

4.3

The posted advertisement for vacant accommodation must be in English, and the accommodation provider is responsible for ensuring that the information provided in the advertisement is true and accurate. The accommodation provider warrants that the accommodation provider holds all intellectual property rights to the material uploaded to the Accommodation Search Engine. If any uploaded material infringes third party rights, such material will be removed as soon as the Accommodation Search Engine is made aware of the infringement. The Accommodation Search Engine may show the uploaded material or part of it on other websites, on social media and on its business partners’ media. Advertisements for vacant accommodation may not include any contact details such as telephone numbers, email and website addresses, or other details. If the User breaches the above provision, the User’s account will be closed immediately, and the advertisement deleted. The User must disable the advertisement for vacant accommodation immediately when the accommodation is no longer vacant.

4.4

When sending offers or other information to accommodation searchers, the accommodation provider must make sure not to disclose other Users’ contact details to others. Consequently, the accommodation provider may not contact more than one User in the same email in a way that allows the Users to see each other's email addresses.

4.5

The following services are available to accommodation providers free of charge: i) they may advertise a vacant accommodation allowing accommodation searchers who are PremiumUsers to contact them, ii) they receive an email notification of relevant accommodation searchers who advertise for available accommodation, and iii) they may obtain contact details of accommodation searchers who advertise for available accommodation and who have upgraded to become PremiumUsers. The following advantages are available to accommodation providers who are PremiumUsers: i) their advertisements will get a higher position in the list of search results, ii) they may be contacted by all accommodation searchers (whether they are PremiumUsers or not), and iii) they may contact all accommodation searchers who advertise for accommodation. 

4.6

An accommodation provider advertising a vacant accommodation may be contacted by accommodation searchers by email or telephone. 

5. Disclaimer

5.1

The Accommodation Search Engine is a platform with user-generated content, where accommodation providers with vacancies are matched with accommodation searchers looking for accommodation. The Accommodation Search Engine only facilitates information. Hence, the Accommodation Search Engine does not guarantee the accuracy of any information provided by Users or assume responsibility for any agreement entered into directly between Users. The User accepts that the total liability that may be incurred by the Accommodation Search Engine is in any circumstances DKK 0 (zero).

5.2

It is of no concern to the Accommodation Search Engine whether the contact established between Users through the Accommodation Search Engine results in an agreement between them.

5.3

Where the Accommodation Search Engine retrieves information directly from the website of a property company or a third party, the Accommodation Search Engine does not guarantee the accuracy of such information.

6.1

7. Payment and right of cancellation

7.1

All Accommodation Search Engine services are purchased online, and all prices are stated inclusive of VAT. Payment takes place online by e.g. Dankort, Visa card, MasterCard, Ideal/Direct Debit, Paypal or other payment methods.

7.2

Both accommodation providers and accommodation searchers may create a user account with the Accommodation Search Engine free of charge. Users may purchase a number of optional subscription services providing certain advantages. Subscription services are purchased as follows: i) Create a user account or log in to an existing user account. ii) Choose “Additional service” in the menu under your profile. iii) Confirm that you want to subscribe and accept automatic withdrawals from your payment card at the beginning of each new subscription period. iii) Enter your payment details and approve the purchase. As soon as you have approved the purchase, the subscription is activated and you can start using the relevant services. The subscription service will continue until cancelled. Thus, the Accommodation Search Engine will automatically withdraw the subscription fee from your payment card at the beginning of a new subscription period, unless the subscription is cancelled before then. You may cancel your subscription as described in paragraph 7.5. The subscription is not subject to any non-terminability restrictions. Any cancellation of the subscription will therefore take effect from the date of expiry of the current subscription period. The subscription can not be cancelled in the digital interface with the first 3 hours of purchase. However, the subscription can always, from the time it has been bought, be cancelled by sending an email to [email protected]. If payment for a new subscription period cannot be collected, the Accommodation Search Engine will make new attempts at collecting the amount for a period of time in order to avoid unintentional termination of the subscription, so that the user does not unintentionally lose the service and benefits that the user expects to receive. Furthermore, the Accommodation Search Engine will attempt to make the payment when the user tries to access the benefits that the subscription gives and that the user expects to have. 

7.3

Users who have purchased services from the Accommodation Search Engine will receive a confirmation by email as prescribed by law.

7.4

If the User’s payment card expires or is blocked, the subscription will be terminated at the end of the current period.

7.5

To disable a PremiumUser subscription, click on your profile at the top of www.housingtarget.com, then click the page “Invoices etc.”, then click the button “Access program” at the bottom, and then follow the guide on the page that appears after clicking the button “Access program”. The subscription must be cancelled by the User personally to prevent third parties from disabling the User’s subscription against his/her wishes. When the User has unsubscribed, no further amounts will be withdrawn from the User’s payment card, and the PremiumUser access will terminate automatically on expiry of the current subscription period.

7.6

All invoices can be found on the page “Invoices”.

7.7

Subscribers to the Accommodation Search Engine are allowed a statutory right to withdraw of 14 days. Users may exercise the right to withdraw by sending an email to [email protected].

8. Unauthorised use of the Accommodation Search Engine

8.1

Any unauthorised use of the Accommodation Search Engine or breach of the Terms will be deemed a material breach of these Terms, entitling the Accommodation Search Engine to close the User’s account and delete all content posted by the User. If the Accommodation Search Engine finds the breach to be of a particularly serious nature, the User may be excluded permanently from the Accommodation Search Engine.

8.2

If any act or omission by the User causes information on the Accommodation Search Engine to be lost or causes harm or damage to the Accommodation Search Engine or to other Users, then the User is liable under the general rules of Danish law for any loss incurred as a result of such harm or damage. The User is not liable for any indirect loss such as loss of profit or loss of revenue. For this purpose, loss of data is considered a direct loss. In the event that a User causes harm to another User, the Accommodation Search Engine is entitled to assign its claim against the User causing the harm to the aggrieved User.

8.3

The User may not decode the Accommodation Search Engine or try to get access to the source code or related documentation in any other way, including the structure of the Accommodation Search Engine, except as justified by normal use of the Accommodation Search Engine.

8.4

The User may not sell, transfer, distribute, licence, let, lease, or lend access the Accommodation Search Engine to any other party or give such party access to the Accommodation Search Engine.

9. Choice of law and jurisdiction:

9.1

These Terms and any other agreement entered into between the Accommodation Search Engine and the User are subject to Danish law. However, if the User is a consumer who has his place of residence in either Sweden, Germany, the Netherlands, Finland or Norway, mandatory provisions of the consumer protection laws of the country in which the User has his/her place of residence remain applicable.

9.2

Any dispute arising between the Accommodation Search Engine and the User which cannot be settled amicably is to be settled by the courts of Denmark with Copenhagen City Court as the court of first instance. However, if the User is a consumer who has his place of residence in either Sweden, Germany, the Netherlands, Finland or Norway, any dispute may instead be settled by the courts of the country where the consumer has his place of residence.

If relevant, the User may also file a complaint with a competent consumer authority in his country of residence:
