1. General terms
1.1
These terms and any other supplementary terms referred to herein (collectively referred to as the “Terms”) apply to any use of www.housingtarget.com (referred to as the "Housing Search Engine"). The Terms apply to the User’s use of the Housing Search Engine, which is operated by Housingtarget.com ApS, Mynstersvej 3, 1827 Frederiksberg, Denmark, Central Business Register (CVR) no.: 36997761. “User” means a person who creates an account with the Housing Search Engine. "PremiumUser" means a User who has purchased a subscription service which provides a number of advantages. These advantages are described in section 3.2 for housing seekers, and in Section 4.5 for housing providers. The Housing Search Engine only shows housing available in EU/EEA. 
1.2
The Housing Search Engine is partially a fully automatic market platform, where Users can post user-generated content in the form of housing advertisements or housing seeker ads , where housing seekers can access each other’s contact information, and where Users can access relevant search results in the form of housing or seekers.
1.3
The Housing Search Engine is partially a search engine which aggregates vacant accommodation from freely accessible websites through crawling.
1.4
Functionality for housing seekers: The Housing Search Engine is a search engine that gives housing seekers an overview of vacant accommodation rentals on the market at a given time. The Housing Search Engine crawls the internet looking for vacant accommodation on accessible websites and shows a few raw data extract from the available accommodations in the search results. The search results are displayed in English; however, the source of the information may often be an accessible website in local language (jointly referred to as "Local Language"). In order to give the User as comprehensive an overview of the housing market as possible, housing advertisements from non-profit housing associations are included, which may require paid membership of the housing association and which may have long waiting lists, as well as accommodations from payment portals if it is assessed that these are only available on the payment portal. If the housing seekers wishes to know more about the accommodation, he is forwarded to the original source. Some of the accommodation on the Housing Search Engine is advertised by the housing providers themselves. For these, an email with the housing provider’s contact details is sent on the email when the housing seekers requests further information. It should be pointed out that the Housing Search Engine does not establish direct contact between housing seekers and housing providers, nor has the Housing Search Engine entered into any agreements with housing providers for that purpose. It is emphasized that in most cases, the housing seeker must upgrade to become a PremiumUser in order to get further details on the accommodation. If a housing seeker creates a search ad, housing providers may contact the housing seeker by email or telephone and offer accommodation that fits their preferences (paragraph 3.2 specifies which services are available free of charge to all Users and which services are available to PremiumUsers only).
1.5
Functionality for housing providers: Housing providers may use the Housing Search Engine to market their vacant accommodation. A housing provider may create an advertisement for available accommodation, or contact housing seekers who have posted an advertisement for available accommodation directly. When contacting a housing seeker via a housing seeker ad, the housing provider will receive an email with the housing seeker’s contact details. The housing provider must upgrade to PremiumUser in order to contact all housing seekers (paragraph 4.5 specifies which services are available free of charge to all Users and which services are available to PremiumUsers only).

2. Registration, cookies and emails
2.1
By creating a User profile on the Housing Search Engine, the User accepts these Terms.
2.2
As a User, you can unsubscribe from ordinary service emails (emails that relate to the Housing Search Engine's functionality) (minus the statutory emails such as invoice emails), request or unsubscribe from match emails (emails where the User is notified of relevant newly offered accommodation or relevant new housing seekers) by clicking "Your profile" in the upper right corner and then selecting the "Mail settings" tab where the User can change the settings. As a User, you can also always click on the link at the bottom of all emails. By clicking this link, the User arrives at a page where the User can set which emails the User wishes to receive.
2.3
The User may at any time withdraw all consents by disabling his/her profile at the bottom of the page “Your data” under “Your profile”. The page is seen by clicking ”Your profile” in the top right corner (the User must be logged in).
2.4
The Housing Search Engine uses cookies for many necessary functions, to improve the user experience, and for marketing and statistical purposes. At the first visit on the website, the user chooses which cookies can be used. When using the Housing Search Engine, the User agrees to the use of cookies in accordance with the terms laid down by the Housing Search Engine. The User can always delete cookies stored on the User’s computer in connection with his/her use of the Housing Search Engine, or change the selections about which cookies can be used. See a detailed description in our Cookie Policy.
2.5
The User must stay updated on these Terms of use of the Housing Search Engine, and the User accepts that the Housing Search Engine has the right to change the Terms of use with 30 calendar days’ notice. All significant changes to the Terms of use will be communicated by the Housing Search Engine. This information will be visible on the User's account when the User is logged in. If the changes involve legal privacy or marketing issues which require renewed consent, the User will be asked to give such consent when logging on to the Housing Search Engine next time. The price of existing subscriptions will never be changed.
2.6
The User has the right to disable his/her account on the Housing Search Engine without notice. If the User has a subscription, the User must cancel the subscription before the account can be disabled to avoid loosing the remainder of the subscription period without intent hereof.

3. For housing seekers

3.1
A housing seeker is a person who is currently looking for accommodation. Only persons looking for new accommodation can register as housing seekers with the Housing Search Engine. The posted Housing Seeker Profile must be in English, and the User must ensure that the content of the posted advertisement is true and accurate and that no contact details such as telephone numbers or email and website addresses are included. The Housing Search Engine may show the uploaded material or part of it on other websites, on social media and on its business partners’ media. The User must disable the search ad immediately and within no longer than two days, when the search is no longer relevant. If the User fails to do so, the User’s account will be closed immediately, and the advertisement deleted.
3.2
The following services are available to the housing seeker without payment: The housing seeker may create a housing seeker ad, through which the housing seeker can be contacted by housing providers who are PremiumUsers. The housing seeker may receive email notifications of relevant accommodations. The housing seeker may contact housing providers who are PremiumUsers. The housing seeker receives the following benefits by upgrading to PremiumUser: The housing seeker’s housing seeker ad will be highlighted and is ranked higher in search results. The accommodation seeker may be contacted by all housing providers (not only PremiumUsers). The housing seeker receives faster email notifications of the most sought-after accommodation. The housing seeker gets access to all accommodations advertised in the Housing Search Engine (if an accommodation has been posted, the housing seeker will receive the housing provider’s contact details, and if an accommodation has been detected by the crawler, the housing seeker will receive a link to the source).
3.3
When registering as a housing seeker, the User is obligated to post a housing seeker advertisement for accommodation with a description of the housing seekers preferences for accommodation within 3 working days.
3.4
The housing seeker may upload a photo when posting the housing seeker ad. It is the full responsibility of the housing seeker to ensure that the photo is relevant, customary and lawful as determined by the Housing Search Engine, that it is not of a sexual nature, and that the housing seeker holds the necessary intellectual property rights to the photo. If any uploaded material infringes third party rights, such material will be removed as soon as the Housing Search Engine is made aware of the infringement.
3.5
When the housing seeker creates a housing seeker ad, housing providers may contact the housing seeker by email or telephone and offer accommodation that fits their preferences.
3.6
In the advertisement for available accommodation, the housing seeker may offer the housing provider various assistance. The housing seeker may only offer ordinary, legal and non-infringing services as determined from time to time by the Housing Search Engine (as an example, the User may not offer sexual services). The housing seeker must always be paid separately for such services in accordance with applicable law and may e.g. not accept a rent reduction as remuneration. It is the Users’ own responsibility to ensure that agreements for provision of services are entered into in accordance with applicable law, including for tax reporting purposes.
3.7
The housing seeker accepts that the Housing Search Engine's accommodation database cannot be 100 percent updated and that errors may occur in a minor portion of the search results or ads. Partly, a housing provider who has created an accommodation advertisement on the Housing Search Engine can, for example, forget to deactivate the advertisement when the accommodation is no longer available. Partly, it cannot be avoided that an accommodation is taken down from an external website for a short period of time before the Housing Search Engine's robot visits the website where the accommodation is advertised. Partly, it cannot be avoided that accommodations that are no longer on the market sometimes will continue to appear as available on external websites, because the webmaster of the external website forgot to update this. If a housing seeker upgrades to PremiumUser in connection with an ad that contains errors, the housing seeker is entitled to a refund of that subscription period.
3.8
The housing seeker confirms that it is the responsibility of the housing seeker to validate that a housing provider has the right to holds the right to let the accommodation, and that all information about an accommodation is correct, before an agreement is made with a housing provider, and before any payment is transferred to the housing provider, as described in the guide “Use your common sense”.

4. For housing providers
4.1
A housing provider is a person (for example a private landlord, real estate agent or administrator) who has right to rent out an available accommodation. When registering as a housing provider, the User undertakes to contact housing seekers only with offers for accommodation that match the housing seeker’s preferences and needs as specified in the advertisement for accommodation.
4.2
Housing providers may only advertise vacant accommodations which they have a clear, written authorization to handle or which are owned by themselves.
4.3
The posted advertisement for vacant accommodation must be in English, and it is the full responsibility of the housing provider to ensure that the information provided in the advertisement is true and accurate. The housing provider warrants that the housing provider holds all intellectual property rights to the material uploaded to the Housing Search Engine. If any uploaded material infringes third party rights, such material will be removed as soon as the Housing Search Engine is made aware of this. The Housing Search Engine has the right to show the uploaded ad content or part of it on other websites, on social media and on its business partners’ media. Advertisements for vacant accommodation may not include any contact details such as telephone numbers, email and website addresses, or other details. If the User breaches this provision, the User’s account will be closed immediately, and the advertisement deleted. The User must inactivate the advertisement for vacant accommodation immediately when the accommodation is no longer vacant.
4.4
When sending offers or other information to housing seekers, the housing provider must make sure not to disclose other Users’ contact details to others. Consequently, the housing provider may not contact more than one User in the same email in a way that allows the Users to see each other's email addresses.
4.5
The following services are available to the housing provider without payment: The housing provider may advertise a vacant accommodation allowing housing seekers who are PremiumUsers to contact the housing provider. The housing provider receives email notifications of relevant housing seekers who have created a housing seeker ad. The housing provider may obtain contact details of housing seekers who have created a housing seeker ad and have upgraded to  PremiumUsers. The housing provider gets the following advantages by upgrading to PremiumUser: Advertisements for accommodation created by the housing provider will rank higher of search results. The housing provider may be contacted by all housing seekers (whether they are PremiumUsers or not). If the housing provider has created an active advertisement for accommodation the housing provider may contact all housing seekers who have create a housing seeker ad.
4.6
When a housing provider creates an advertisement for vacant accommodation, the housing provider may be contacted by housing seekers by email or telephone.

5. Disclaimer
5.1
The Housing Search Engine is an automatic platform with User-generated content, where housing providers and housing seekers advertise vacant accommodations and requests for accommodation. The Housing Search Engine only facilitates the information and does not assume responsibility for any information provided by Users or for any agreement entered into directly between Users. The User accepts that the total liability that may be incurred by the Housing Search Engine in no circumstances can be more than 0 (zero) ​Euro .
5.2
It is of no concern to the Housing Search Engine whether contact information delivered from the Housing Search Engine ​results in an agreement between Users. The Housing Search Engine does not establich contact between housing seekers and housing providers.
5.3
Where the Housing Search Engine retrieves information directly from the website of a property company or a third party, the Housing Search Engine is not responsible for the accuracy and correctness of such information.
5.4
The User is personally responsible for the information published by the User in the Housing Search Engine.
5.5
The Housing Search Engine is an automatic market platform, where Users can create advertisements for accommodation. When an advertisement for accommodation is created, the Housing Search Engine only makes a general automatic software-based quality control of the content of the ad. Except for this automatic quality control, the Housing Search Engine does not validate new housing ads. Errors in ads may occur in advertisements for accommodation, for example typing errors in rent, errors in contact information etc., and it may occur that a User against the terms and conditions of the Housing Search Engine creates an advertisement for an accommodation that the User has no right to handle. If the Housing Search Engine is informed about errors or omissions in a housing ad, including that the housing provider has no right to handle the accommodation, then the advertisement will be removed and investigated for the error. The User accepts that the Housing Search Engine has no responsibility for errors or omissions in advertisements on the Housing Search Engine, including when an advertisement for an accommodation has been created by a User that does not have the right to handle the accommodation. 6.1

7. Terms of subscription, payment and the right of withdrawal
7.1
All Housing Search Engine services are purchased online, and all prices are stated inclusive of VAT. Payment is charged online by use of one of the available payment methods, e.g. Dankort, Visa card, MasterCard, Paypal or other payment methods.
7.2
Both housing providers and housing seekers may create a User account with the Housing Search Engine free of charge (see 3.2 and 4.5). In addition to the free account service, we offer a number of optional services, which provide certain advantages and require a subscription. Paragraph 7.10 describes how to terminate the subscription.
7.3
How to buy a PremiumUser subscription: Create a User account or log in to an existing User account. Click on “Your profile” in the top right corner of the screen (you must be logged in to see it) and choose “Buy access”. Confirm that you wish to subscribe and accept automatic charge from the selected payment method. We will charge the selected payment via the chosen payment at the beginning of each new subscription period. Enter your payment details and approve the purchase. As soon as you have approved the purchase, the subscription is activated and you can start using the relevant subscription services.
7.4
Current subscription prices: When upgrading to PremiumUser for the first time, the price is 1.49 Euro for the first day and then 14.90 Euro per 7 days in an ongoing subscription. The subscription fee is automatically charged by use of the User's chosen payment method at the beginning of a new subscription period, until the subscription is cancelled. If the User cancels the subscription within 24 hours of purchasing the subscription, the User pays the minimum price of 1.49 Euro. If the User has previously been a PremiumUser, the price is 14.90 Euro per 7 days in an ongoing subscription. The subscription fee is automatically charged by use of the User's chosen payment method at the beginning of a new subscription period, until the subscription is cancelled. There is no minimum commitment periode on the subscription beyond the current subscription period. Subscription prices for new subscriptions may in some periods vary as a result of special offers and / or changes in subscription periods. Once the User has purchased a subscription, the price will not change during the subscription period.
7.5
If a payment is not successfully settled, the Housing Search Engine will make new attempts at collecting the amount for a period of time or by relevant activity in order to avoid unintentional termination of the subscription, so that the User does not unintentionally lose the service and benefits that the User expects to receive, such as quick information about new accommodation on the market.
7.6
Users who have purchased services from the Housing Search Engine will receive an email confirmation.
7.7
If the User’s payment card expires or is blocked, the subscription will be terminated at the end of the current period.
7.8
All invoices can be found on the page “Invoices”.
7.9
How to exercise your right of withdrawal: Subscribers to the Housing Search Engine are allowed a statutory right to withdraw of 14 days. Users may exercise the right to withdraw by sending an email to [email protected].
7.10
How to cancel a PremiumUser subscription: Click on ”Your profile” at the top of www.housingtarget.com (you must be logged in to see your account). Then click the page “Invoices etc.”, then click the button “Access program” at the bottom, and then follow the guide on the page that appears after clicking the button “Access program”. When the User cancels the subscription, no further amounts will be charged from the User’s payment card (or by use of other payment method), and the PremiumUser access will terminate automatically on expiry of the current subscription period.

8. Unauthorised use of the Housing Search Engine
8.1
Any unauthorised use of the Housing Search Engine or breach of the Terms will be deemed a material breach of these Terms, entitling the Housing Search Engine to close the User’s account and delete all content posted by the User. If the Housing Search Engine finds the breach to be of a particularly serious nature, the User may be excluded permanently from the Housing Search Engine.
8.2
If any act or omission by the User causes information on the Housing Search Engine to be lost or causes harm or damage to the Housing Search Engine or to other Users, then the User is liable under the general rules of Danish law for any loss incurred as a result of such harm or damage. The User is not liable for any indirect loss such as loss of profit or loss of revenue. For this purpose, loss of data is considered a direct loss. In the event that a User causes harm to another User, the Housing Search Engine is entitled to assign its claim against the User causing the harm to the aggrieved User.
8.3
The User may not decode the Housing Search Engine or try to get access to the source code or related documentation in any other way, including the structure of the Housing Search Engine, except as justified by normal use of the Housing Search Engine.
8.4
The User may not sell, transfer, distribute, licence, let, lease, or lend access to the Housing Search Engine to any other party or give such party access to the Housing Search Engine.

9. Choice of law and jurisdiction:
9.1
These Terms and any other agreement between the Housing Search Engine and the User are subject to Danish law. However, if the User is a consumer who has his place of residence in another country in the EU/EEA, mandatory provisions of the consumer protection laws of the EU/EEA country in which the User has his/her place of residence remain applicable. The Housing Search Engine only shows housing available in EU/EEA countries.
9.2
Any dispute arising between the Housing Search Engine and the User which cannot be settled amicably is to be settled by the courts of Denmark with Copenhagen City Court as the court of first instance. However, if the User is a consumer who has his place of residence in another  EU/EEA country, any dispute may instead be settled by the courts of the country in EU/EEA where the consumer has his place of residence. The Housing Search Engine only shows housing available in EU/EEA countries.
